Deputy Supervisor McCulloch called the meeting to order.  Town Attorney Smith stated the purpose of the meeting is to entertain a request by the gun range Sheepdog to extend the statute of limitations on the ZBA’s interpretation of March 12th and filed in the Office of the Town Clerk on March 15th affirming the CEO’s decision prohibiting the gun range for law enforcement training.  

 

Ms. Smith states this purpose is to permit the opposition and town to explore the concept of a possible amendment of the zoning law with the potential result creating a special use for gun range activities.  This agreement will give time to explore that.  Without it, Sheepdog’s decision is to commence an Article 78 proceeding by April 15th and the Town will be engaged in litigation.

 

Councilwoman Scannapieco asked what the law may look like.  Mr. Smith stated the gun range is in an RA district and special use is granted by the Planning Board as a membership club/recreational use.  There is an issue with police training.  If the law is amended, it could create a special use for gun range and take out of the category for recreational use.  Mr. Fishman mentioned the police training as an accessory use or a separate full blown category for a gun range.  Councilman Vosburgh stated it will not make any more noise if the gun range is involved in police training or recreational use.  

 

Mr. Smith stated the action of the board this evening is to adopt a resolution granting an extension of time to explore an amendment.

 

Resolution # 20-2019 on motion by Councilman Vosburgh, second by Councilwoman Scannapieco authorizing the Deputy Supervisor sign the tolling agreement for claims arising out of the determination of the Town of Catskill Zoning Board of Appeals on the appeal of Sheepdog Warrior LLC and North Mountain Game Farm, LLC.  Adopted Vote: 3 Yes 2 Absent (Davis & Giordiano)

 

For their information Mr. Smith also stated that before the Planning Board is a request for modification of the special use permit increasing the target range to a 1,000 yard and 3,000 yard.  This is on hold.

 

With no further business a motion to adjourn the meeting was made by Councilman Vosburgh second by Councilwoman Scannapieco.  Meeting ended 5:52 pm.
