Also Present: Michel Smith (Town of Catskill Attorney) Elliot Fishman (Town of Catskill C.E.O.)

 

Chairman Joe Izzo opened the meeting with the Pledge of Allegiance to the flag.


 

OLD BUSINESS:

 

Site Plan Review SPR-2-2019 & SUP-3-2019 Balle Mayo Properties 1147 Main Street, Leeds.

 

Mr. Holtz recused himself from the review of SPR-2-2019 & SUP-3-2019.

 

The applicant submitted revised plans addressing the requested 12 parking spaces, handicap parking, entranceways and lighting, an emergency gate for outside seating, walkway for tenants, and entrance for deliveries.

 

The Board reviewed the plans.

 

Mr. Fishman asked where the garbage would be located.

 

Mr. Murphy indicated on the site plan where the dumpsters are currently located towards the back of the site.

 

Mr. Fishman stated it is up to the Board to decide if the parking for apartment, will require signage.

 

Mr. Murphy stated there are plenty of parking spaces.

 

Ms. Golden asked if there will be lighting for the dumpster.

 

Mr. Holtz answered the original site plan shows the lighting.

 

Ms. Golden made a motion to accept this preliminary Site Plan for SUP-3-2019 & SPR-2-2019, seconded by Mr. Decker

 

5 Ayes, 0 Nays, 1 Absent, 1 Abstention,   Motion Carried.

 

Mr. Federman made a motion to schedule a Public Hearing to be held at 7:00 P.M. on May 14, 2019, seconded by Mr. Decker.

 

5 Ayes, 0 Nays, 1 Absent, 1 Abstention,   Motion Carried.

 

Mr. Izzo stated the application will be sent to the Greene County Planning Board for a 239 Review.


 

Site Plan Review SPR-1-2019 Jacob Bar-Horin (Pollaces) 71 Landon Avenue Catskill .

 

Mr. Izzo stated the Planning Board had referred this application to the Zoning Board for an interpretation, but since then the Town Attorney has recommended, In lieu of the State of New York Supreme Court, Appellate Division, Third Judicial Department’s March 28, 2019 Decision in the matter of Yeshiva Talmud Torah Ohr Moshe v Zoning Board of Appeals of the Town of Wawarsing for the Planning Board to rescind the request for an Interpretation from the Zoning Board and for the Planning  Board to continue with the application as a Site Plan Review .

 

Mr. Smith gave a narrative on the decision of Yeshiva Talmud Torah Ohr Moshe v Zoning Board of Appeals of the Town of Wawarsing and the similarity to the application SPR-1-2019 which is currently before the Town of Catskill Planning Board.

 

Mr. Izzo read aloud a resolution rescinding the request for SPR-1-2019 to obtain an interpretation from the Town of Catskill Zoning Board.

 

Mr. Federman made a motion adopting the resolution rescinding the request for the SPR-1-2019 to obtain an Interpretation from the Town of Catskill Zoning Board, seconded by Ms. Golden.

OTHER BUSINESS:

 

Special Use Permit SUP-1-2017 North Mnt. Game Farm 104 Hines Rd. Catskill.

 

Mr. Rivenberg asked the Board if at any time when he presented his application before the Board had any of the Board remembered that he had spoken about using the site for police training.

 

Mr. Izzo answered “yes;

 

Mr. Rivenberg stated the Towns attorneys’ paper work indicates police training was never recorded. Someone had assigned recreational and membership club, as the description for the use of his business.

 

Mr. Izzo stated the Zoning Board has made their determination and it was determined that there can be no police training on the range. He had also recommended for the applicant to come back to the Planning Board to continue the review of the revision to the Site Plan for the Special Use Permit in order to follow through on the project . The Planning Board can not approve police training. When the Planning Board had made their decision for the Special Use Permit, it was under the impression that the use was correct, but the Interpretation was sent to the Zoning Board and the Zoning Board is an appellate court. The Planning Board can continue with the review for the long range, also police can continue to shoot at the range, but it must be on their own time.

Ms. Golden made a motion approve the work session meeting minutes for March 20, 2019 as written, seconded by Mr. Decker

Ms. Golden made a motion approve the meeting minutes for March 26, 2019 as amended, seconded by Mr. Decker

 

6 Ayes, 0 Nays 1, Absent   Motion Carried.

 

The Board reviewed the recommended changes to the Planning Board By-Laws, and Governing Rules for Public Hearings, as incorporated by Mr. Decker.  Also the recommended changes by Mr. Fishman (CEO) for the Site Plan Review application were discussed.

 

Mr. Izzo stated the Governing Rules are only guide lines for the Board, The Governing Rules can never contradict the Towns Codes or the any of the NY State Codes.

 

Mr. Decker stated he will revise the By-Laws and distribute them to the Board . The next copy will be revision 0 and will be the final revision.

 

Mr. Izzo asked Mr. Fishman if he approves of the Site Plan Application.

 

Mr. Fishman answered “Yes”.

 

Mr. Izzo asked if anyone had any questions or concerns for the Board.

 

There were no questions or concerns.

 

Mr. Holtz made a motion to adjourn Mr. Izzo seconded it
