Also Present: Michel Smith (Town of Catskill Attorney) Elliot Fishman (Town of Catskill C.E.O.)

 

The Board reviewed the recommended revisions to the Site Plan Applications and check list.

 

Mr. Izzo stated the application will require a thorough sketch plan conference before coming before the Board

 

Mr. Smith stated the applicant must list uses in detail for the site plan and for the applicant to be as explicit as possible, and then the CEO will review the application.

 

The Board discussed the detail and description for uses.

 

Mr. Decker stated the planning Board requiring explicit details on a Special Use Permit and or a Site Plan review is only a band aid for addressing the Towns Zoning needing to be updated.

 

Mr. Izzo stated the review process should not discourage individuals from doing the right steps  . The Board does not want to complicate the process too much or make it too expensive because it will discourage individuals from coming before the Board for approvals. It’s the CEO responsibility to determine how much information is required for a Site Plan application or a Special Use Permit based on how comfortable the CEO is with the project, then the application can come before the Planning Board.

 

Mr. Fishman stated regarding the Site Plan Review Check lists, a lot of the Towns Code Requirements are not making it onto the Site Plans, and are also not being addressed with waivers.

 

The Board discussed #22 and # 23 and # 25 of the Site Plan Review check list.

 

Mr. Holtz stated in regards to improvements of adjacent properties, a surveyor cannot trespass on a neighbor’s lands.

 

Mr. Izzo stated any waiver submitted to the Planning Board requires a Public Hearing.

 

Mr. Fishman asked if the Board had evered review a Site Plan Review that was not drawn by a professional.

 

Mr. Izzo answered the Town Law does not require a license professional to draw the site plans for application submitted to the Planning Board. The Planning Board does require all drawings be drawn by a professional surveyor, architect or engineer.

 

Ms. Golden stated she would suggest a column for the site plan check list to indicate NA.

 

Mr. Smith stated there should be way of determining when a site plan is necessary and when its is not necessary.

 

Mr. Izzo stated in cases where a site plan may not be necessary the applicant can be sent to the Planning board and the board can make the determination.

 

Mr. Federman stated the Town Code does not give the CEO leed way for not requiring a site plan.

 

Mr. Decker stated then the applicant can submit a waiver.

 

The Board discussed the significance of #26 on the Site Plan check list .

 

Mr. Izzo stated the applicant can always indicate NA

 

Mr. Smith stated he will review the application along with the CEO and make any recommendations he believes should be added to the application.

 

Mr. Fisherman stated he will check into some of the suggested changes as per referenced to the Town’s Code and also he will add in check list waiver and a waiver for a site plan if the site is already an existing commercial use.

 

The Board discussed the requirements for the abutters list.

 

Mr. Izzo stated the requirement for certified mail should be 100 feet and or at the discretion of the Planning Board. The changes suggested tonight will be reviewed again. These changes will also mirror the Special Use Permit.

 

Mr. Fishman stated he will send out an email for both the Site Plan review application and the Special Use Permit. He will also check with the Town Supervisor to see if the revisions to the  application have to be approved by the Town Board .

 

Mr. Holtz stated he would also suggest the application be uploaded to the Town’s website.

 

The Board reviewed the recommended changes to the Governing Rules for the Planning Board.

 

Mr. Decker stated he had made the changes all the way up to section ( 5 training) . He made section # 6  (Regulatory Rules) and also the (SEQRA) as references only and moved to section # 8 . He moved decision and Finding to section # 7 and Public Hearings to #6.

 

Mr. Izzo asked if the Board has had a chance to review the changes from section 6.1 to 8.4.

 

Mr. Fishman suggested changes to 1.1, 2.1, 2.26 and 2.2.3.

 

Mr. Federman suggested changes to 3.6 and 3.4 addressing the cancellation of meetings.

 

Mr. Izzo stated normally if a meeting is cancelled it is announced on the Towns website and a notice goes on Town Hall front door.

 

Mr. Decker stated the rule will be written and cancellation will be announced on the Towns website and Town Hall door.

 

The Board discussed notification of public hearings.

 

Mr. Fishman stated under (d ) it should be indicated a minimum of 15 days.

 

The Board discussed 6.1.3 (b)

 

Mr. Izzo stated the Board will discuss the changes at the next meeting.

 

Mr. Holtz made a motion to adjourn Mr. Izzo seconded it
