Public Hearing Local Law 4 of 2019

SECTION 1. PURPOSE

The purpose of this local law shall be to amend Local Law No. 4-2010, Chapter 78 (Animals) of the Code of the Town of Catskill.

SECTION 2. AUTHORITY

This local law is enacted pursuant to Section 10 of the Municipal Home Rule Law.

SECTION 3. AMENDMENT OF LL NO.4-2010 AND ENACTMENT OF NEW PROVISIONS

Local Law No.4-2010 is hereby amended and reenated subject to the modifications and amendments provided as follows:

SECTION 4, SECTION 78-4 IS AMENDED AS FOLLOWS:

Section 78-4 Definitions

As used in this article the following terms shall have the meaning indicated:

Companion animal or pet means any dog or cat, and shall also mean any other domesticated animal normally maintained in or near the household of the owner or person who cares for such other domesticated animal.

SECTION 5. SECTION 78-6 RESTRICTIONS, PROHIBITIONS AND VIOLATIONS IS AMENDED AS FOLLOWS:

Section 78-6 restrictions, Prohibitions and Violations

Engage in habitual and loud howling, barking or whining or to conduct itself in such a

manner so as to unreasonably and habitually annoy any person for a time period that is continuous and exceeds 15 continuous minutes at any time of day.

Chase or otherwise harass any person, companion animal or pet in such a manner as

reasonably to cause intimadation or to put such person, companion animal or pet in a reasonable apprehension of bodily harm or injury or to cause bodily harm or injury.

SECTION 6. INCONSISTENT LOCAL LAWS AND RESOLUTIONS

This Local Law contains references only to the new, amended or repealed sections of Chapter 78 of the Town Code. The new and amended sections shall supersede all prior inconsistent sections and provisions of this Chapter.

SECTION 7. SEVERABILITY

Should any paragraph, section or portion of this Article be declared by a court of competent jurisdiction to be invalid or unlawful, the same shall not affect the remainder of this Article as a whole or any part thereof other than the part so declared to be invalid.

SECTION 8. EFFECTIVE DATE

This Local Law shall take effect immediately upon its adoption and filing with the Office of Secretary of State.
