Supervisor Izzo opened the meeting with a moment of silent prayer and the Pledge of Allegiance. He thanked all for attending.
Supervisor Izzo introduced Gary Harvey who surveyed the Catskill Rural Cemetery. The Town of Catskill had to take over the Cemetery because Catskill Rural decided not to operate it any longer.
Mr. Harvey stated that there are two large parcels. Parcel #2 is the Babe Ruth Field which is 9.64 acres and parcel #1 which is the cemetery is 22.28 acres. He stated there is another piece of property which is isolated by the new road the State put in. It is an approximately 5 acre parcel to the east of New York State 23. He is still investigating access issues related to that property. The State came through and took the property, they did it without access.
There is an apparent encroachment area behind Pilatich & Associates property. It is a railroad retaining wall that extends into the parking lot of the Babe Ruth field. He does not believe there was any official easement or right of use of that property. Mrs. Austin used to own parcel #2 and leased the property to the Babe Ruth League up until 1966. She then sold the property to the Catskill Rural Cemetery Association. Mr. Harvey does not know the arrangements of the lease agreement to date. He spoke with Mr. Wagman and what will be done is that a new metes and bounds description. Supervisor Izzo stated that is the last piece in order to execute a new agreement between the Town and the Babe Ruth Foundation for use of the field.
Mr. Harvey stated there is also another small parcel on the map, Parcel #1A, which is .21 acres. It is occupied by the Cemetery but inadvertently indicated on Highway taking maps as part of the NYS Route 23. He stated we should get the State to sign off because there are graves on that site.

RESOLUTION #124-2007 AMENDMENT OF
RESOLUTION 108-2006
CASINGS CONTRACT
Councilman Walsh, presented the following for consideration and adoption,
WHEREAS, the Town Board has been requested by Casing, Inc. to modify the agreement between the Catskill Town Board and Casing, Inc., this agreement dated June 29th, 1995, for “section 2, Businesses” by updating the language “For the first 250, the charge will be $.75 per tire” because of the change in prices and economic conditions that have occurred in the tire business since 1995, so
WE THEREFORE RESOLVE, to amend the revised agreement dated December 20, 2006 for “Section 2, Businesses”, by updating the language “For the first 250 tires, the charge will be .75 cents per tire.
Councilman Antonelli, seconded this motion.

This was amended because there was an error in the original resolution from December of 2006. The tape of that meeting shows that the corrected amount the Board agreed on was .75 per tire for the first 250 tires (businesses only).
Supervisor Izzo reviewed the County resolutions.
Supervisor Izzo reviewed the Correspondence.
We received a letter from the Office of Small Cities. We had sent an application for a grant, which was denied (low income housing).
The speed limit on Vedder Road will be reduced to 35 mph per the DEC once they file with the NYS Clerk.
Councilman Leggio spoke about meeting with the Village merchants and the idea of having a first night. The merchants stated that they would prefer to have that celebration on the last Saturday night stroll. Councilman Leggio stated to them that the Town Board may sponsor the fireworks for that evening.
RESOLUTION #128-2007 AUTHORIZE $3,500.00 FOR FIREWORKS DISPLAY DURING HOLIDAY STROLL.
Councilman Leggio, offered the following for consideration and adoption,
WHEREAS, the Merchants‘ Association will be having their last Saturday Stroll on December 08, 2007, and
WHEREAS, the Misbehaven Fireworks Corporation has been contracted to provide fireworks for said stroll, and
WHEREAS, the Town of Catskill has been asked to contribute to the cost of said fireworks, and
WHEREAS, at a cost of $3,500.00, the aforementioned fireworks company will assume the responsibility for obtaining required license and permits; and $2,000,000.00 liability insurance, per contract, so
THEREFORE, WE, the Catskill Town Board hereby approve the total cost of $3,500.00, for the Fireworks Display, on December 08, 2007, monies to come from the General “A“ Fund..

Letter from Berlin Central School District who is having a presentation with UCLA Professor Richard Schoenin who will look at future green in communities.
Matt Leibowitz announced that Ambulance received a grant for the Mass Causality Incident Trailer in the amount of $14,000. This trailer allows the EMS service to treat individuals in a mass accident/incident. The trailer comes fully stocked with supplies that can treat between 25 and 30 patients on scene.
Request from Ambulance for a tuition assistance reimbursement for Mr. Brooks who completed his intermediate EMS course.
RESOLUTION # 125-2007 TUITION ASSISTANCE PROGRAM REIMBURSEMENT (BROOKS)
Councilman Antonelli, offered the following for consideration and adoption,
WHEREAS, the Town of Catskill has a Tuition Assistance Program for employees, and
WHEREAS, Robert Brooks, an Ambulance Squad Employee, with permission from the Ambulance Administrator, has completed the EMT Intermediate Course, and
WHEREAS, Mr. Brooks has submitted proper documentation, so
THEREFORE, WE, the Catskill Town Board do hereby approve Tuition Reimbursement, in the sum of $ 590.00, to Robert Brooks.

The Wase property on Sunny Valley Road has been demolished. Mr. Wase is working with Ms. Yander to repair her septic system.
A public hearing needs to be scheduled for Joel Fallik because he has unregistered motor vehicles on his property and he has not complied with the notice of remedy.
RESOLUTION # 126-2007 SCHEDULE A PUBLIC HEARING FOR NON-
COMPLIANCE, JUNK LAW(Fallik property)
Councilman Lewis O‘Connor, presented the following for consideration and adoption,
WHEREAS, existing violations of the Code of the Town of Catskill, Junk, Chapter 15,
Section 115-19, persist at 100 Paradise Lake Road, Town of Catskill, Tax Map #154.00-1-10,and
WHEREAS, Order to remedy was issued by Code Enforcement Officer, Linda J. Speckman, to be complied with before December 04, 2007, and
WHEREAS, (if) violations continue to exist, so
THEREFORE, WE RESOLVE, to hold a Public Hearing, #23-2007, on the aforementioned matter, on December 04, 2007, at 6:00 PM, at Catskill Town Hall, 439-441 Main Street, Catskill, NY, to hear comments and concerns regarding continued non-compliance.

Ms. Speckman has given everyone specifications and prices for a four wheel drive vehicle. There are four model. One is an Equinox ($20,028.96), Laredo ($20,502.02), Trail Blazer ($20,622.80), and a Durango ($20,886.74). These prices include delivery charge. The mileage on the Equinox is 17/24, Laredo is 15/20, Trail Blazer 15/21, and the Durango 15/20.
Councilman Antonelli stated that since there is only a $600 difference between the Equinox and the Trail Blazer, he recommends the trail blazer since one of the employees has a back problem.
Councilman Walsh asked about the fuel efficiency. Councilman Antonelli stated there is only a 2 mpg difference between the two so fuel efficiency should not be a problem. He also stated that if the Board needed to go somewhere as a group, the trail blazer would be more accommodating.
Supervisor Izzo said the money will be encumbered from this year’s budget from fund balance and it will be purchased next year.
RESOLUTION # 127-2007 AUTHORIZE PURCHASE OF ‘08 TRAILBLAZER VEHICLE @ STATE BID PRICE
(Code Dept.).
Councilman Antonelli, offered the following for consideration and adoption,
WHEREAS, the current vehicle in use by the Code Enforcement Office is not in good condition, and not expect to be able to perform safely during the winter months, and
WHEREAS, there has been a need for a larger sized vehicle, and specifications and prices obtained, and
WHEREAS, it has been determined that the 2008 Trailblazer LS Vehicle, 4 door, 4x4, (CT15506), will meet the Department’s needs, and
WHEREAS, there are monies which can be encumbered from the 2007 fund balance, so
THEREFORE, WE, the Catskill Town Board do hereby authorize purchase of aforementioned vehicle, at the State Bid price of $ 20,242.80, and an additional delivery charge of $ 380.00, for full cost of $20,622.80.

The Code Enforcement Officer requested that we revise our fees for our building, septic, demolition permits, fire inspections, certificate of occupancy, planning boards fees and zoning board fees.
Ms. Speckman stated the fees have not been restructured, except for the co permit for about 20 years. The fee is one half percent of the market value of the total construction. The State has now added three more inspections on construction. The have suggested that the fees should be based on the cost of department to process the whole permit so the department can be self-sufficient.
Ms. Speckman then discussed the Department of State’s suggested fees. The Town Board suggested changing some of the fees. Linda will revise the fee schedule per the Board’s suggestions and will discuss at the December Town Board meeting. Supervisor Izzo stated to any of the Board members if they have any questions to contact Linda directly.
Ms. Speckman was also approached by the Department of State asking if she would give a presentation to the City of Monticello regarding code violations because our program is so effective at approaching those in the Town.
Matt Leibowitz, Ambulance Administrator, has signed up 30 kids for the cadet program.
Supervisor Izzo, who sits on the advisory board for St. Lawrence Cement, had a presentation from the Soccer club, which encompasses between 300-400 kids. They are going to lease to the soccer club 50 acres off Embought Road in order for them to build a field(s). It will be leased for one dollar a year for 30 years.
The engineer who works for the School District looked at the site and has recommendations for a parking area, pavilion, and one soccer field. The soccer club has been promised material from the Village and businesses in Catskill. One soccer field will cost approximately fifteen to twenty thousand dollars.
The Board has been trying to help with youth programs. The Town has the funds available. The Supervisor’s thought was to set aside $20,000 to aid the Soccer Club to build an additional field. This would be under a contract with the Town. This is for the Board to consider.
Councilman Leggio would like to set up a meeting with the Soccer Club to discuss this.
He would like to invite the members to the Committee meeting on November 20th.
Dan Howard, Planning Board Chair, stated that when the Town goes through SEQR for the joint comprehensive plan, if the Village is included as an involved agency, then they will not have to go through SEQR.
Supervisor Izzo stated that we have already sent our SEQR form to the interested parties. We did not indicate that the Village of Catskill would be part of it.
Dan also stated that Allen Uhler’s term is up this year. He will discuss with his Board about reappointment.
There was some discussion regarding the noise ordinance and if the law would be changed. Supervisor Izzo stated that if the law changes, then it is town wide. Councilman O’Connor has contacted the Association of Towns to view the different noise ordinances that the Board can look at. He is hoping to have the issue resolved by Memorial Day.
There was discussion regarding Joel Fallik and the removal of his mobile home. The Town’s attorney sent Judge Carl a letter stating the Town’s position. If there is no response, or if they say they will not sign the order to remove, then the next step will be the Supreme Court.
