Special Meeting #1- Complete the Environmental Assessment Form part 2, and adopt the SEQR Determination Resolution.
Subdivision SUB-09-2011 Rosana Thompson, Mossy Hill Rd. Catskill.
The Board discussed the factors on the EAF form Part 2 for Rosana Thompson SUB-09-2011 with all answers being “No.”
Mr. Izzo read aloud the SEQR Determination Resolution.
Mr. Sacco made a motion to accept this SEQR Negative Declaration for Rosana Thompson SUB-09-2011, seconded by Mr. Rivituso.
Ayes 5, Nays 0, Absent 1, Motion Carried.

NEW BUSINESS:
Public Hearing Subdivision SUB-09-2011 Rosana Thompson, Mossy Hill Rd, Catskill.
Chairman Joseph Izzo opened the Public Hearing for Subdivision SUB-09-2011 Rosana Thompson, Mossy Hill Rd, Catskill. The Notice of Public Hearing was published in the Daily Mail on January 4, 2012 and January 5, 2012
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE, the Town of Catskill Planning Board will hold a public hearing in accordance with Town Law § 276 and the Town of Catskill Subdivision Regulations on January 10, 2012 at 7:10 PM at Town Hall, 439-441 Main Street in the Town of Catskill, to consider a minor 2 lot subdivision of land located on Mossy Hill Rd ,Catskill ,NY proposed by Rosana Thompson Written and oral comments will be accepted until the close of the public hearing.
Mr. Izzo asked if anyone would like to comment on this proposed subdivision.
No questions or comments were made.
Mr. Rivituso made a motion to close the Public Hearing SUB-09-2011, seconded by Mr. Sheridan.
Ayes 5, Nays 0, Absent 1, Motion Carried.
The Public Hearing was closed at 7:13 PM.
OLD BUSINESS:
Subdivision SUB-9-2011 Rosana Thompson, Mossy Hill Rd. Catskill.
Chris Brewer is an engineer from Brewer Land Surveyors and is representing the applicant in this minor subdivision. The applicant submitted a final plat with a mylar.
he Board reviewed the plat.
Mr. Federman stated the map should demonstrate the combined parcle B and parcel 1 without a property line between them.
Mr. Izzo stated parcel B and parcel 1 had been combined by the assessor for tax purposes but the deeds were never changed to reflect the parcels being combined.
Discussion ensued.
Mr. Izzo stated the parcels were combined for taxation purposes only, parcel B and parcel 1 still have 2 separate deeds. The deed’s must reflex that the parcel’s were combined.
Mr. Brewer stated once the applicant has approval from the Board to subdivide parcel 1 from lot 2, then any new deeds will reflex lot B being combined with lot 1.
The Board discussed the procedure for combining parcels
Mr. Federman stated if the applicant submitted a letter to the County requesting that the parcels be combined, then the requirements for combining parcels should be satisfied.
Mr. Izzo asked if the Board has ever received a copy of the letter that was sent to the County or the Town of Catskill‘s Assessor for the purpose of combing the lots.
The Planning Board Secretary answered “No”.
Mr. Federman stated the Board did request to see a copy of the document at the December 13, 2011 meeting.
Mr. Federman asked why the final plat demonstrates a property line between parcel B and the proposed lot 1.
Mr. Brewer answered the map indicates that the property line is to be deleted, and that it would be standard procedure to indicate what had once been a separate parcel.
Mr. Izzo stated the proposed final plat calls out for a lot line adjustment and a subdivision, but the Board is only reviewing the application as a subdivision. A lot Line adjustment would be considered a separate action by the Board.
Discussion ensued.
Mr. Izzo stated the Board can take a vote on this application and if approved it could be approved with the condition that the applicant supply the Board with sufficient proof of lot B having been legally combined with lot 1.
Mr. Sacco made a motion to approve SUB-9-2011 with the condition that documentation be submitted to the Planning Board indicating that parcel B was combined with parcel #1 consisting of 25.07 acre parcel, seconded by Mr. Federman.

Mr. Izzo stated tomorrow the Planning Board Secretary will contact the Town of Catskill Assessor and request any paper work that was submitted to the Town regarding the combining of parcel B with parcel #1and then contact the applicant with the information.
Mr. Brewer asked since the applicaiotn indicates that the applicant had applied for a lto line adjustment would the request still sand if the Board determines that a lot line adjustment is required.
Mr. Izzo answered ‘Yes”.
Discussion ensued regarding the deed.
Mr. Izzo thanked the applicant.
OTHER BUSINESS:
Meeting Minutes of December 13, 2011 were reviewed Federman made a motion to accept the minutes as written, seconded by Mr. Izzo.
