Monthly Meeting
August 12, 2008, 7:00 PM
Present: Chairman Daniel Howard-PE, Vice Chairman Peter Gustas, Warren Sheridan, Allen Uhler, Jack Rivituso, Harry~Sacco, Larry Federman, Secretaries Jennifer Kalb and Patricia Case-Keel.
Absent: All Present.
Chairman Dan Howard opened the meeting with a moment of silent prayer and the Pledge of Allegiance to the flag.
New Business:
Special Meeting #1- Complete the Environmental Assessment Form part 2, and adopt the SEQR Determination Resolution.
Subdivision SUB-10-2008 Roberta Patterson Ross, McLaren Road, Catskill.
The Board discussed the factors on the EAF form Part 2 for Roberta Patterson Ross SUB-10-2008 with all answers being “No.”
Mr. Howard read aloud the SEQR Determination Resolution.
Mr. Gustas made a motion to accept this SEQR Negative Declaration for Roberta Patterson Ross SUB-10-2008, seconded by Mr. Rivituso.

With no further business to discuss Mr. Sacco made a motion to close Special Meeting #1, seconded by Mr. Federman.

Public Hearing SUB-10-2008:
Chairman Dan Howard opened the Public Hearing for Subdivision SUB-10-2008 Roberta Patterson Ross, McLaren Road, Catskill. The Notice of Public Hearing was published in the Daily Mail on August 6, 2008 and August 7, 2008.
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE, the Town of Catskill Planning Board will hold a public hearing in accordance with Town Law § 276 and the Town of Catskill Subdivision Regulations on August 12, 2008 at 7:10 PM at Town Hall, 439-441 Main Street in the Town of Catskill, to consider a minor 2 lot subdivision of land located on McLaren Road proposed by Roberta Patterson Ross. Written and oral comments will be accepted until the close of the public hearing.
Mr. Howard asked if anyone would like to comment on this proposed subdivision.
No questions or comments were made.
Mr. Rivituso made a motion to close the Public Hearing SUB-10-2008, seconded by Mr. Sacco.

The Public Hearing was closed at 7:11 PM.
Minutes of the July 22, 2008 meeting were reviewed. Mr. Gustas made a motion to accept the minutes as written, seconded by Mr. Rivituso.

Subdivision SUB-10-2008 Roberta Patterson Ross, McLaren Road, Catskill.
The Board received documentation from the Town of Cairo Planning Board with no objections to the proposed project, and a revised EAF was also submitted by the applicant.
Mr. Rivituso made a motion to adopt the resolution for SUB-10-2008 Roberta Patterson Ross, seconded by Mr. Sheridan.

Subdivision SUB-7-2007 Lucille Bertone, Vosenkill Road, Catskill.
Mr. Howard read aloud the conditions in the final plat approval resolution.
Mr. Federman made a motion to adopt the resolution for SUB-7-2007 Lucille Bertone, seconded by Mr. Rivituso.

Subdivision SUB-04-2008 Ronald Smith, 164 Ufferts Road, Catskill.
Mr. Smith submitted a revised plan to the Board for review.
Mr. Smith is proposing a lot line revision between Lots 1A and 1B giving parcel 1A access to Ufferts Road for road frontage, and parcel 1B will have existing access through the existing right of way on Paul Saxe Road.
Mr. Gustas made a motion to declare the project a complete application and hold a public hearing for Subdivision SUB-04-2008 as at 7:10 PM on August 26, 2008, seconded by Mr. Sacco.
Ayes 7, Nays 0, Absent 0, Motion Carried.
The Public Hearing was set for August 26, 2008 at 7:10 PM.
New Business:
Special Use Permit SUP-03-2008 James Gantz, 5629 Cauterskill Road, Catskill.
The applicant is applying for a special use permit to convert from a single family dwelling to a two family dwelling. A site plan was presented to the Board.
Mr. Howard and the Board reviewed the site plan.
The proposed project must be submitted to the County Planning Board for 239 due to the location on a County road.
Mr. Gustas made a motion to declare the project a complete application and hold a public hearing for Subdivision SUP-03-2008 at 7:15 PM on August 26, 2008 pending the 239 Review by the Greene County Planning Board, seconded by Mr. Federman.

The Public hearing requires the applicant to notify all the surrounding neighbors within 300 feet of the public hearing by certified mail receipt. The Public hearing date needs to be changed to allow sufficient time for the mailings.
Mr. Gustas made a motion to amend the previous motion, and hold a public hearing for Subdivision SUP-03-2008 at 7:10 PM on September 9, 2008 pending the 239 Review by the Greene County Planning Board, seconded by Mr. Federman.

The Public Hearing was set for September 09, 2008 at 7:10 PM.
Subdivision SUB-11-2008 Estate of Ronald Stetkewicz, 374 Foster Road, Catskill.
The applicant is applying for a minor 2 lot subdivision.
9 Copies of the Plat map and EAF were provided for the Board.
The Board reviewed the plat plan using the checklist to ensure all required items are noted on the plans.
Mr. Howard stated all the items are shown and appears to meet all the requirements according to the Subdivision regulations.
Mr. Gustas made a motion accept the project as a complete submittal and to hold a public hearing for Subdivision SUB-11-2008 at 7:15 PM on August 26, 2008 seconded by Mr. Sacco.

Mr. Gustas made a motion to declare lead agency on the proposed project, seconded by Mr. Rivituso.

The Public Hearing was set for August 26, 2008 at 7:15 PM.
Subdivision SUB-12-2008 Steven Levine, 59 Snake Road, Catskill.
Mr. DiMauro is representing the applicant for this proposed project. A letter was submitted by Mr. Levine granting permission for Mr. DiMauro to represent him. There are 2 lots both owned by Mr. Levine, the applicant is applying for a lot line adjustment to obtain creek view frontage. No construction is being proposed at this time.
The Board reviewed and discussed Section 140-17 in the subdivision regulations.
Mr. Howard stated according to Section 140-17 under lot improvements, this proposal meets the requirements.
Mr. Rivituso made a motion to accept the lot line adjustment, seconded by Mr. Sheridan.
Ayes 7, Nays 0, Absent 0, Motion Carried.
Mr. Howard stated for the applicant to obtain a finalized map with the special endorsement printed on the map according to section 140-17 of the Town’s subdivision regulations.
Other Business:
Mr. Pluschau came before the Board to seek advice on a potential project within the Town of Catskill.
Discussion ensued.
With no further business to discuss Mr. Gustas made a motion to adjourn, seconded by Mr. Federman.
