Town of Catskill Planning Board
Monthly Meeting
July 22, 2008, 7:00 PM
Present: Chairman Daniel Howard-PE, Vice Chairman Peter Gustas, Warren Sheridan, Allen Uhler, Jack Rivituso, Harry~Sacco, Secretary Jennifer Kalb.
Absent: Larry Federman.
Chairman Dan Howard opened the meeting with a moment of silent prayer and the Pledge of Allegiance to the flag.
Minutes of the June 24, 2008 meeting were reviewed. Mr. Gustas made a motion to accept the minutes as written, seconded by Mr. Sheridan.
Ayes 5, Nays 0, Absent 2, Motion Carried.
Mr. Howard stated the Board received a correspondence from the Town Highway Superintendant Alfie Beers advised the Board with regard to Mountain Turnpike, the letter indicated the portion in front of Mr. Anisuzziman’s property is not a part of Town maintenance. The secretary of the Board will notify the applicant and will proceed from there.
Mr. Howard stated on Tuesday August 5, 2008 at 5:30PM the Town Board will hold a public hearing on the Town of Catskill Planning Board’s proposed subdivision changes.
Old Business:
Subdivision SUB-08-2008 George & Mary Playford, Cairo Junction Road, Catskill.
Gary Harvey is representing the proposed project, revised plans was presented to the Board.
Mr. Harvey stated since the last meeting that the project was discussed, on the map the wetland boundaries were indicated and the Conservation zoning district was identified. Mr. Harvey also stated the engineer Scott Lane conducted perk tests on the property, the septic system has been moved to the north side of the property and is greater than 100 feet distance from the wetlands. The soil conditions have been provided.
Mr. Harvey stated the proposed project is a 2 lot minor subdivision, there are 2 additional houses passed the Playford’s property, and there is an existing private road.
Mr. Howard asked what the acreage is for the other two lots.
Mr. Harvey stated approximately 2 acre lots, these lots were subdivided in the 1980’s.
Mr. Howard asked Mr. Harvey what the current proposal for the road is. Pending any potential changes by the Town Board, the Planning Board currently requires a full street according to the current Town code.
Mr. Harvey stated there is no new street or access proposed.
Mr. Howard stated under the current code every house to front on a street and any streets that are not town streets need to be built according to Town standards.
New Business:
Subdivision SUB-09-2008 Gary & Monica O’Malley, Mossy Hill Road, Catskill.
Mr. Lonergan is the attorney representing the proposed project.
Mr. Lonergan stated the applicant purchased the properties lots 8 and 8A consisting of approximately 12.6 acres, the property is bisected by the Central Hudson strip that is indicated on the map. The property is accessed over an old wood road and it extends through the properties. His client would like to have the properties separated into 2 individual lots, the applicants don’t have any intentions to improve the lot but would like to have the opportunity to in the future.
Mr. Howard asked if the remainder of the property is owned by others.
Mr. Lonergan answered yes.
Mr. Howard asked if the existing private road shown on the map provides access back into the other properties.
Mr. Lonergan stated there is a right of way that crosses into lot 8A.

Mr. Howard stated currently there are a couple issues with the proposed project, the current code every house to front on a street and any streets that are not town streets need to be built according to Town standards. The Board hopes the Town Board will considers the recommendations for situations of this nature. The property borders property owned by Central Hudson Gas and Electric Company. Mr. Howard asked the applicant to contact Central Hudson to identify their access and review their deed showing where the right of way lines are.
Mr. Howard stated the Board would like a response back from Central Hudson to determine what they would allow Mr. Lonergan’s client to do. At this point the Board needs that information, and the soil types will be need to be identified and places on the plans, there didn’t appear to be any other missing items.
Subdivision SUB-10-2008 Roberta Patterson Ross, McLaren Road, South Cairo.
Rich Sardo is the surveyor representing the project.
Mr. Sardo stated the parcel consists of 11 acres and the applicant proposes cutting out 5.6 acres for a building lot residence. There is an existing driveway with culverts on the location due to the Town of Cairo granting the applicant a driveway permit.
Mr. Howard asked if a portion of McLaren Road is in the Town of Catskill or maintained by Cairo?
Mr. Sacco stated the Town of Catskill Highway Department maintains a portion of the road.
Mr. Sardo stated the Town of Cairo line is very close, majority of the property is in the Catskill. The proposed building location fronts Mclaren Road.
Mr. Howard stated question #7 on the EAF needs to be revised to reflect the entire 5.6 portion. The soil types on the property need to be noted on the plans. A portion of the property is located in the Town of Cairo, the Board can declare lead agency once a complete submittal is received. Mr. Howard also stated it is appropriate the Board work with the Town of Cairo Planning Board for coordinated review. The Board will await a response from the Town of Cairo Planning Board’s Chairman.
Mr. Gustas made a motion to hold a public hearing for Subdivision SUB-10-2008 at 7:10 PM on August 12, 2008, seconded by Mr. Rivituso.
Ayes 6, Nays 0, Absent 1, Motion Carried.
The Public Hearing was set for August 12, 2008 at 7:10 PM.
Other Business:
Subdivision SUB-7-2007 Lucille Bertone, Vosenkill Road, Catskill.
Mr. Howard updated the applicant on the progress of her proposed project.
With no further business to discuss Mr. Gustas made a motion to adjourn, seconded by Mr. Sheridan.
Ayes 6, Nays 0, Absent 1, Motion Carried.
