Planning Board Meeting Minutes 04/08/2008
Town of Catskill Planning Board
Monthly Meeting
April 8, 2008, 7:00 PM

Present: Chairman Daniel Howard-PE, Vice Chairman Peter Gustas, Warren Sheridan, Harry Sacco, Allen Uhler, Larry Federman, Jack Rivituso, Secretary Jennifer Foxe.

Absent: All Present.

Chairman Dan Howard opened the meeting with a moment of silent prayer and the Pledge of Allegiance to the flag.

New Business:  

Special Meeting #1- Complete the Environmental Assessment Form part 2, and adopt the SEQR Determination Resolution.

Subdivision SUB-02-2008 Enrico Ribet, 1030 Route 23A, Catskill.

The Board discussed the factors on the EAF form Part 2 for Enrico Ribet SUB-02-2008 with all answers being “No.”

Mr. Howard read aloud the SEQR Determination Resolution.

Mr. Federman made a motion to accept this SEQR Negative Declaration for Enrico Ribet SUB-02-2008, seconded by Mr. Rivituso.

With no further business to discuss Mr. Sheridan made a motion to close Special Meeting #1, seconded by Mr. Sacco.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

Mr. Gustas is present at 7:06 PM.

Public Hearing SUB-02-2008:

Chairman Dan Howard opened the Public Hearing for Subdivision SUB-02-2008 Enrico Ribet, 1030 Route 23A, Catskill.  The Notice of Public Hearing was published in the Daily Mail on April 2, 2007 and April 3, 2007.
                
                        NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE, the Town of Catskill Planning Board will hold a public hearing in accordance with Town Law § 276 and the Town of Catskill Subdivision Regulations on April 8, 2008 at 7:15 PM at Town Hall, 439-441 Main Street in the Town of Catskill, to consider a minor 3 lot subdivision of land located at 1030 Route 23A proposed by Enrico Ribet. Written and oral comments will be accepted until the close of the public hearing.

Mr. Howard asked if anyone would like to comment on this proposed subdivision.

No questions or comments were made.

Mr. Gustas made a motion to close the Public Hearing SUB-02-2008, seconded by Mr. Rivituso.

Ayes 7,  Nays 0,  Absent 0,  Motion Carried.

The Public Hearing was closed at 7:16 PM.

Minutes of the March 25, 2008 meeting were reviewed. Mr. Federman made a motion to accept the minutes as amended, seconded by Mr. Gustas.

Ayes 7, Nays 0, Absent 0, Motion Carried.

Old Business:

SUB-07-2007 Lucille Bertone, Vosenkill Road , Catskill.

Mr. Gustas made a motion for the Planning Board to declare lead agency on the project, seconded by Mr. Sacco.

Ayes 7,  Nays 0,  Absent 0,  Motion Carried.

The Board proceeded through Part 2 of the EAF prepared by Clough Harbour and Associates.

Mr. Bianchino stated the draft part 2 of the EAF is based on the first submission that was made to the Town Planning Board, which had identified some potential impacts. Since that time there have been significant plan revisions in terms on the impact of land and concerns based on the presence of the steep slopes. The current plans appear to address these concerns and the steep slopes do not present an issue at this point in time. Based on the information submitted it appears the project will not have any significant impacts.

Discussion ensued.

Scott Lane asked if a waiver can be requested concerning major subdivision law 140-20 (D) common open space. The 1.3 acres that would be required for Open Space for recreational purposes, parks, or play lots do not seam to be viable for this Layout. These 5 lots range from 1.7 to 3.2 acres and all connect directly through driveways to a local town road, and the parcels will not to be further subdivided.

Mr. Howard stated a written request pertaining to section 140-20 of the law identifying the reasons the Board should consider the entertain the request and it needs to be submitted to the Planning Board for review at the next meeting.

Mr. Sacco made a motion to hold a public hearing for Subdivision SUB-07-2007, seconded by Mr. Gustas.

Ayes 7,  Nays 0,  Absent 0,  Motion Carried.

The Public Hearing was set for April 22, 2008 at 7:15 PM.

Subdivision SUB-27-2007 Floyd & Linda Mower, 136 Stony Brook Road, Palenville.

Scott Lane provided the Board with the soil classifications and revision to SEQR from the last meeting.

Mr. Howard stated the Board has a complete submittal at this time from the applicant.

Mr. Sterthous asked for Scott Lane to identify the adequate amount of road frontage of the parcel.

Mr. Federman made a motion for the Planning Board to declare lead agency on the project, seconded by Mr. Rivituso.

Ayes 7,  Nays 0,  Absent 0,  Motion Carried.

Mr. Gustas made a motion to hold a public hearing for Subdivision SUB-27-2007, seconded by Mr. Uhler.

Ayes 7,  Nays 0,  Absent 0,  Motion Carried.

The Public Hearing was set for April 22, 2008 at 7:25 PM.

Subdivision SUB-02-2008 Enrico Ribet, 1030 Route 23A, Catskill.

Mr. Conrad is the surveyor for Mr. Ribet.

Mr. Conrad provided the Board with sight distances that the Board had requested at the last meeting.

Discussion ensued regarding the speed on Route 23A.

Mr. Howard stated the project was sent to NYS DOT for their review, and they did not indicate there were any immediate issues with the Route 23A side of the property. The Board is waiting on documentation confirming this. Mr. Howard also stated the Board is approving a subdivision, and in this case the parcel is a double frontage lot due to the way it exists. For safety considerations the Board can impose a restriction that if the Board feels it is not safe
to have driveways onto Mountain Turnpike, any possible approvals would be to require the driveways to be located on the NYS route 23A side.

Mr. Howard suggested Mr. Conrad contact Mr. Izzo at NYS DOT.

Applicant Interpretation- Subdivision SUB-03-2008 David Grasse & Marcie Clarke
6287 Route 32, Catskill.

Mr. Conrad is the surveyor for the proposed subdivision.

Mr. Conrad stated there are 4 different property owners with 4 separate deeds.

There was brief discussion regarding different options and concepts that would apply to the Town’s subdivision law.

Mr. Sterthous requested for Mr. Conrad to provide a narrative identifying all the property owners and the concept of the project.

Mr. Conrad stated he would reconfigure the site plan and submit it to the Board for review.

Other Business:

There was a brief discussion amongst the Board members in regards to addressing the concerns received from the public at the last meeting. The Board discussed some possible recommendations pertaining to the minor subdivision law.

The Board will be furthering discussing these recommendations at a later time.

The Board opened the meeting for public comments.

Mr. Kistinger had submitted a letter to the Board with his personal feelings and possible recommendations for the Board to consider (Please see attached to minutes).

Discussion ensued amongst the public and the Board with regards to the town’s subdivision law.

With no further business to discuss Mr. Gustas made a motion to adjourn, seconded by Mr. Sacco.
