Town of Catskill Planning Board
Monthly Meeting
March 25, 2008, 7:00 PM
Present: Chairman Daniel Howard-PE, Vice Chairman Peter Gustas, Harry Sacco, Warren Sheridan, Allen Uhler, Larry Federman, Jack Rivituso, Secretary Jennifer Foxe.
Absent: All Present.
Chairman Dan Howard opened the meeting with a moment of silent prayer and the Pledge of Allegiance to the flag.
Minutes of the March 11, 2008 meeting were reviewed. Peter Gustas made a motion to accept the minutes as amended, seconded by Harry Sacco.

Old Business:
SPR-2-2007 William Walsh, 1113 Main Street , Leeds .
Mr. Walsh presented the revised site plan before the Board. All the missing items on the sketch plan are now shown, and the requested documentation was provided.
Mr. Rivituso made a motion to accept as a complete application, seconded by Mr. Gustas.
Ayes 7, Nays 0, Absent 0, Motion Carried.
Mr. Howard stated this complete submittal will be sent to the County Planning Board for a 239 review.
SUB-06-2007 Volosk LLC, 439 Cauterskill Road , Catskill.
Mr. Drao provided a revised site plan now showing all the items from the Site Plan Checklist.
Mr. Drao stated he is waiting to receive the well reports and a letter from Central Hudson.
Mr. Howard stated the project may be subject to NYS DEC storm water plan.
Mr. Drao stated there are no designated wetlands noted on the property.
Mr. Howard stated the Board will need to have a letter stating there are no designated wetlands on the property, and to submit a municipally enforceable home owner’s agreement.
The Town attorneys will continue to further review the new information received.
SUB-07-2007 Lucille Bertone, Vosenkill Road , Catskill.
Mr. Lane stated provided documentation that the Board had requested at the last discussion.
Mr. Howard stated the project is close to a complete submittal, the attorneys will review the documents provided. The project will be further discussed at the next scheduled meeting.
Special Use Permit SUP-2-2007 (Hotel & Restaurant) Murarui Brothers Inc. 3335 Route 23A, Catskill.
Special Use Permit SUP-3-2007 (Multi Family Dwelling) Murarui Brothers Inc. 3335 Route 23A, Catskill.
Mr. Howard stated one of the concerns is that the bridge is an important historic structure, and there would be public access to at least see the bridge not necessarily use it. The Board would like to know the applicant’s thoughts were regarding the bridge and possible public access to it, to ensure any issues that come up are addressed.
Mr. Lane stated the applicant would rather not have this issue delay the project, there is no opposition as long as it is not a liability due to the swimming hole along the property.
Mr. Howard stated historically the Town has looked into seeing if access could be gained since it is a historical site in the Town.
Mr. Howard stated there are currently 3 driveway accesses to Route 23A.
Mr. Lane stated yes.
Mr. Howard asked Mr. Lane if there was an easement for the Town or NYS DOT to access the culvert.~ The access to the culvert needs to be identified for future use. There are a many multiple uses identified on the property. The Board needs a traffic impact study provided to show how many rooms, square footage, and peak hours, to develop a parking scheme that meets the requirements. The project will be subject to SEQR process and NYS DOT will be an involved agent, they will need to see these numbers. There are existing apartments over the library and there needs to be adequate parking for those.~
Mr. Lane stated he needs to contact the applicant and forward the information to him, to see if the applicant still wishes to proceed with the application.
Subdivision SUB-27-2007 Floyd & Linda Mower, 136 Stony Brook Road, Palenville.
Mr. Lane stated there are 3 separate deeds, the Board’s decision was to consider the project a minor 3 lot subdivision.
Mr. Howard stated the project will subject to SEQR process due to the fact there are federal wetlands on the property.
Mr. Lane stated NYS DOT has given their approval.
Mr. Howard stated the Board needs to see noted on the plans the soil classification on Lot 3, and revise question #6 on the EAF.
Subdivision SUB-29-2007 Anthony Tuzzolo, 275 Route 32, Catskill.
Scott Lane stated he is waiting to receive the road maintenance agreement from the applicant’s attorney, and for NYS DOT to provide a letter for the sight distances.
Mr. Howard stated a copy of the plans will be forwarded to NYS DOT for their comments.
Subdivision SUB-04-2008 (Minor), Ronald Smith, 164 Ufferts Road , Catskill.
Mr. Howard stated the Town attorney provided a letter to the Board stating the reasons that the access to the gravel road does not comply with the Town code.
Discussion ensued.
Mr. Howard stated the Board needs to make sure access is properly maintained, the Town has issues with many of the roads that are not in good condition. The Board is requiring that any subdivided property has access to a compliant road. Mr. Howard also stated it appears there are other options for the applicant to attend to this issue however; access needs to be in compliance with the Town code.
New Business:
Subdivision SUB-07-2008 (Minor), Colangelo, Route 32 , Catskill.
The applicant provided maps before the Board for review.
Mr. Howard stated there are a few missing items from the checklist that needs to be noted on the plans. The soil types and classifications need to be identified and the Board needs to see specific details, the lines on the survey plat are incomplete and the angles must be shown.
Mr. Colangelo stated the plans are preliminary, pending the Board’s comments.
Mr. Howard stated parcel 4 on the plat shows Federal wetlands and close to the neighbor’s property, and needs to be plotted on the map. Federal wetlands do not have buffer zones and should not cause a problem.
Mr. Colangelo stated they have no immediate plans to build; they are only interested in subdividing the property at this time.
Mr. Howard stated all the lots located on Hearts Content Road have driveway access, and it appears there are no road issues. Mr. Howard recommended the plans be more detailed and have the Federal wetlands identified, the Board can then proceed with the SEQR process.
Other Business:
Mr. O’Connor stated he was coming before the Board as a concerned taxpayer to discuss and clarify some issues regarding the subdivision law.
Discussion ensued.
Mr. O’Connor stated the town should re-examine the subdivision law for minor subdivisions only, due to re occurring issues with applicants.
Mr. Howard stated the Board will further discuss and recommend possible changes to the Town Board.
Mr. Howard thanked Mr. O’Connor for addressing his concerns with the Board, and agreed the current law needs to be reviewed.
With no further business to discuss Mr. Gustas made a motion to adjourn, seconded by Mr. Rivituso.
