Planning Board Special Meeting Minutes 09/06/2007
Town of Catskill Planning Board
Monthly Meeting
September 6, 2007, 7:00 PM
Catskill Town Hall

Present: Chairman Daniel Howard-PE, Vice Chairman Peter Gustas, Allen Uhler, Jack Rivituso, Larry Federman, Warren Sheridan, Secretary Jennifer Foxe.

Absent: Harry Sacco.

Chairman Dan Howard opened the meeting with a moment of silent prayer and the Pledge of Allegiance to the flag.

New Business:  

Special Meeting #1-  Declare Lead Agency on each project, complete the Environmental Assessment Form part 2, and adopt the SEQR Determination Resolution.

Subdivision SUB-16-2007 Michael Carlson, Bogart Road, Palenville.

Mr. Gustas made a motion for the Planning Board to declare lead agency on the project, seconded by Mr. Rivituso.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

The Board discussed the factors on the EAF form Part 2 for Michael Carlson SUB16-2007 with all answers being “No.”

Mr. Howard read aloud the SEQR Determination Resolution.

Mr. Rivituso made a motion to accept this SEQR Negative Declaration for Michael Carlson SUB16-2007, seconded by Mr. Gustas.

Subdivision SUB-17-2007 Maria Deleo, 750 Route 23A, Catskill.

Mr. Howard stated due to the property owner not present yet, the Board will recess Special Meeting #1.

Mr. Gustas made a motion to recess from Special Meeting #1, seconded by Mr. Federman.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.


Public Hearing SUB-16-2007:

Chairman Dan Howard opened the Public Hearing for Special Use Permit SUB-16-2007 Michael Carlson, Bogart Road, Palenville.  The Notice of Public Hearing was published in the Daily Mail on September 2, 2007 and September 3, 2007.

NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE, the Town of Catskill Planning Board will hold a public hearing in accordance with Town Law § 276 and the Town of Catskill Subdivision Regulations on September 6, 2007 at 7:00PM at Town Hall, 439-441 Main Street in the Town of Catskill, to consider a minor 2 lot subdivision of land located on Bogart Road proposed by Michael Carlson. Written and oral comments will be accepted until the close of the public hearing.

Mr. Howard asked if there were any public comments on this proposed subdivision.

No questions or comments were made.

Mr. Rivituso made a motion to close the Public Hearing SUB16-2007, seconded by Mr. Sheridan.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried

The Public Hearing was closed at 7:08 PM.

Mr. Howard opened Special Meeting #2.

Mr. Howard stated that Board member Mr. Federman is an abutting property owner to Mr. Carlson.

Mr. Howard stipulated one condition that should be considered in the approval resolution is for the applicant to understand based on prior discussions with the Planning Board any future proposed minor subdivisions of the properties could result in a positive SEQR Declaration and the requirement for the preparation of the EAF.

Discussion ensued amongst the Board.

Mr. Howard read aloud the Resolution of Subdivision Approval.

Mr. Rivituso made a motion to approve the resolution for SUB16-2007 including the condition; any future proposed minor subdivisions of the properties could result in a positive SEQR Declaration and the requirement for the preparation of the EAF, seconded by Mr. Gustas.

Other Business:

Mr. Howard stated Board members are required by New York State to have 4 hours of training.

Due to conflicting schedules, the Planning Board meeting on September 18, 2007 has been rescheduled for September 20, 2007 at 7:00PM.

Mr. Gustas made a motion to reschedule the September 18, 2007 monthly meeting for September 20, 2007 at 7:00PM, seconded by Mr. Rivituso.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

Mr. Uhler made a motion to recess Special Meeting #2, seconded by Mr. Federman.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

Mr. Howard re opened Special Meeting #1
Subdivision SUB-17-2007 Maria Deleo, 750 Route 23A, Catskill.

Maria Deleo is proposing a minor 2 lot subdivision along Route 23A. Maria Deleo stated she is the property owner, and Mr. Otten is purchasing land from her. There are existing residences on the property.

Mr. Howard stated there have been numerous accidents and fatalities in this particular area.  This project is located on a State road and the Board is in the process of submitting these revised plans to NYS DOT for their review. The Board has a situation with the location of the driveway along this curve; NYS DOT may have some comments regarding this to maximize sight distance to reduce the possibility of accidents re-occurring in this location. The Board is required to notify NYS DOT for them to review this proposed project.

Mr. Rivituso made a motion to close Special Meeting #1, seconded by Mr. Gustas.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

Public Hearing SUB-17-2007:

Chairman Dan Howard opened the Public Hearing for Special Use Permit SUB-17-2007 Maria Deleo, 750 Route 23A, Catskill.  The Notice of Public Hearing was published in the Daily Mail on September 2, 2007 and September 3, 2007.

NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE, the Town of Catskill Planning Board will hold a public hearing in accordance with Town Law § 276 and the Town of Catskill Subdivision Regulations on September 6, 2007 at 7:00PM at Town Hall, 439-441 Main Street in the Town of Catskill, to consider a minor 2 lot subdivision of land located at 750 Route 23A proposed by Maria De Leo. Written and oral comments will be accepted until the close of the public hearing.

Mr. Howard asked if there were any public comments on this proposed subdivision.

No questions or comments were made.

Mr. Gustas made a motion to close the Public Hearing SUB17-2007 and the Planning Board will accept comments written up until September 20, 2007, seconded by Mr. Rivituso.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried

The Public Hearing was closed at 7:43 PM.

Mr. Howard re opened Special Meeting #2

Mr. Federman made a motion for the Town of Catskill Planning Board to declare lead agency on SEQR for this process, seconded by Mr. Uhler.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

The Planning Board will review the Negative Declaration at the September 20, 2007 meeting, in case something comes through with the comments by that time.

Mr. Federman made a motion to close Special Meeting #2, seconded by Mr. Rivituso.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

Mr. Howard stated for Maria Deleo to provide a letter to the Town of Catskill Planning Board identifying that Mr. Otten is authorized to represent the business on this project.

With no further business to discuss Mr. Federman made a motion to adjourn, seconded by Mr. Sheridan.

Ayes 6,  Nays 0,  Absent 1,  Motion Carried.

Meeting Adjourned 7:45 PM.
